TERMS AND CONDITIONS - ENGLISH

By participating in the “Marketplace Jersey Raffle” competition, participants accept these terms and conditions of OneFootball GmbH (hereinafter: “OneFootball”). Participation in the competition is free of charge and independent of the purchase of goods or services.

  • This competition is organized by OneFootball GmbH, Donaustraße 44, 12043 Berlin, Germany.
  • Only individuals who are at least 18 years old (or have reached the higher legal age of majority in their country of residence) and reside in Germany are eligible to participate in the raffle. Employees of OneFootball GmbH (and its affiliates) are excluded from participating in the raffle.
  • OneFootball reserves the right to exclude participants from the raffle for good cause. This may include, but is not limited to, any violations of these terms and conditions, as well as any attempt to manipulate the raffle or disrupt its proper conduct (e.g., through the use of automated scripts, hacking tools, Trojans, or viruses). In these instances, prizes may be subsequently revoked. Specifically, instances of manipulation that may result in exclusion from the raffle include collective or multiple entries (e.g., if a participant creates or uses multiple accounts to enhance their chances of winning).
  • The raffle begins on 18.06.2026 and ends on 25.06.2026, at 5:59 pm (CET) (hereinafter: “Closing Date”).
  • Participation in the raffle is possible exclusively via the app of OneFootball GmbH, Donaustraße 44, 12043 Berlin, Germany. Although participation is only possible via the app and the app is available via the respective app stores (Apple App Store and Google Play Store), this competition is in no way connected to Apple Inc. or Google LLC and is neither sponsored, endorsed, nor managed by them. Apple Inc. and Google LLC assume no responsibility for the content, conduct, or administration of the competition.
  • To enter the raffle, participants must visit a product page in the OneFootball FanShop via a link in a special pop-up message, accept these terms and conditions, and fill in the requested information (email, full name, and country of residence) in the pop-up windows that will open on this product page (the “Participation Data”);
  • The winners will be determined by a random draw among all participants. The winners will be selected from all participants who have met the requirements set out in Section 6 in due time, no later than 48 hours after the Closing Date. 10 Germany jerseys will be raffled among all participants (the “Prize”). Please note that each participant can win a maximum of one jersey.
  • The winners will be notified by OneFootball via e-mail within 48 hours of the raffle's Closing Date. The winners must confirm receipt of the prize notification to OneFootball within 48 hours of receipt and provide their preferred jersey size and postal address (together with the Participation Data, the “Contact Details”) via e-mail for the purpose of prize delivery. In the event that a winner does not provide their postal address to OneFootball within 48 hours of receiving the prize notification, the Prize will be forfeited, and OneFootball reserves the right to select a new winner.
  • By participating in the raffle, the participant expressly agrees that their Contact Details will be processed by OneFootball solely for the purpose of fulfilling the contract related to the shipment of the Prize. OneFootball commits to permanently deleting all Participation Data and Contact Details immediately after the Prize has been shipped. For more information about data protection, please refer to Section 3.9 of our privacy policy.
  • The Prize will be sent to the winners by OneFootball by post. Delivery is limited to Germany and is free of charge. The risk of deterioration or loss of the Prize passes to the winners as soon as the Prize is handed over to the shipping service provider or the post office. OneFootball is not liable for damages, losses, or delays that may occur during delivery.
  • OneFootball is not liable for false information that is expressed and disseminated by participants and/or third parties, including any cooperation partners of OneFootball, in connection with the promotion of the raffle. OneFootball is also not liable for damages caused by technical failures, delays, or interruptions in transmissions, or for damages incurred in connection with participation in the raffle or the acceptance and use of the Prize, except where OneFootball or its agents act intentionally or grossly negligent. Likewise, the liability of OneFootball and its vicarious agents for breaches of contractual obligations and for tort is limited to intent and gross negligence. Claims for damages due to injury to life, limb, health, or essential contractual obligations remain unaffected.
  • Payment of the value of the Prize in cash as well as exchange or payment in kind is excluded.
  • OneFootball reserves the right to cancel the raffle, in whole or in part, at any time without prior notice and without providing reasons. This is particularly applicable if the raffle cannot be carried out as planned, e.g., in the event of computer viruses, software and/or hardware errors, and/or for other technical and/or legal reasons. This also applies in the event of manipulation(s) or attempts at manipulation that compromises the proper conduct of the raffle.
  • Legal recourse is excluded.
  • These terms and conditions shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the provisions of international private law. The exclusive place of jurisdiction for all disputes arising out of or in connection with these conditions shall be Berlin, Germany.
  • These terms and conditions represent the final terms for the raffle. Should individual provisions of these conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining conditions.

TEILNAHMEBEDINGUNGEN - GERMAN

Mit der Teilnahme am Gewinnspiel „Marketplace Jersey Raffle“ akzeptierten die Teilnehmer diese Teilnahmebedingungen der OneFootball GmbH (nachfolgend: „OneFootball“). Die Teilnahme am Gewinnspiel ist kostenlos und unabhängig vom Kauf von Waren oder Dienstleistungen.

  • Dieses Gewinnspiel wird von der OneFootball GmbH, Donaustraße 44, 12043 Berlin, Deutschland, veranstaltet.
  • Zur Teilnahme an der Verlosung sind nur Personen berechtigt, die mindestens 18 Jahre alt sind (oder das in ihrem Wohnsitzstaat/Land höhere gesetzliche Alter der Volljährigkeit erreicht haben) und ihren Wohnsitz in Deutschland haben. Mitarbeiter der OneFootball GmbH (und ihrer verbundenen Unternehmen) sind von der Teilnahme an der Verlosung ausgeschlossen.
  • OneFootball behält sich das Recht vor, Teilnehmer aus wichtigem Grund von der Verlosung auszuschließen. Dies kann unter anderem Verstöße gegen diese Teilnahmebedingungen sowie jeden Versuch der Manipulation oder Störung der ordnungsgemäßen Durchführung der Verlosung umfassen (z. B. durch die Verwendung von automatisierten Skripten, Hacking-Tools, Trojanern oder Viren). In diesen Fällen können Preise nachträglich entzogen werden. Konkret können Manipulationsfälle, die zum Ausschluss von der Verlosung führen können, kollektive oder mehrfache Teilnahmen umfassen (z. B. wenn ein Teilnehmer mehrere Konten erstellt oder nutzt, um seine Gewinnchancen zu erhöhen).
  • Die Verlosung beginnt am 18.06.2026 und endet am 25.06.2026, um 17:59 Uhr (CET) (nachfolgend: „Teilnahmeschluss“).
  • Die Teilnahme an der Verlosung ist ausschließlich über die App der OneFootball GmbH, Donaustraße 44, 12043 Berlin, Deutschland, möglich. Obwohl die Teilnahme nur über die App möglich ist und die App über die jeweiligen App-Stores (Apple App Store und Google Play Store) verfügbar ist, steht dieses Gewinnspiel in keiner Verbindung zu Apple Inc. oder Google LLC und wird weder von diesen gesponsert, befürwortet noch verwaltet. Apple Inc. und Google LLC übernehmen keine Verantwortung für den Inhalt, die Durchführung oder die Verwaltung des Gewinnspiels.
  • Um an der Verlosung teilzunehmen, müssen die Teilnehmer über einen Link in einer speziellen Pop-up-Nachricht eine Produktseite im OneFootball FanShop besuchen, diese Teilnahmebedingungen akzeptieren und die abgefragten Informationen (E-Mail, vollständiger Name und Wohnsitzland) in den Pop-up-Fenstern ausfüllen, die sich auf dieser Produktseite öffnen werden (die „Teilnahmedaten“);
  • Die Gewinner werden durch eine zufällige Auslosung unter allen Teilnehmern ermittelt. Die Gewinner werden spätestens 48 Stunden nach dem Teilnahmeschluss aus allen Teilnehmern ausgewählt, welche die in Abschnitt 6 festgelegten Anforderungen fristgerecht erfüllt haben. Unter allen Teilnehmern werden 10 Deutschland-Trikots verlost (der „Gewinn“). Bitte beachten Sie, dass jeder Teilnehmer maximal ein Trikot gewinnen kann.
  • Die Gewinner werden von OneFootball innerhalb von 48 Stunden nach Teilnahmeschluss der Verlosung per E-Mail benachrichtigt. Die Gewinner müssen den Erhalt der Gewinnbenachrichtigung innerhalb von 48 Stunden nach Erhalt gegenüber OneFootball bestätigen und ihre bevorzugte Trikotgröße und Postanschrift (zusammen mit den Teilnahmedaten die „Kontaktdaten“) per E-Mail zum Zwecke des Preisversands mitteilen. Falls ein Gewinner seine Postanschrift nicht innerhalb von 48 Stunden nach Erhalt der Gewinnbenachrichtigung an OneFootball übermittelt, verfällt der Gewinn, und OneFootball behält sich das Recht vor, einen neuen Gewinner auszuwählen.
  • Mit der Teilnahme an der Verlosung erklärt sich der Teilnehmer ausdrücklich damit einverstanden, dass seine Kontaktdaten von OneFootball ausschließlich zum Zwecke der Vertragserfüllung im Zusammenhang mit dem Versand des Gewinns verarbeitet werden. OneFootball verpflichtet sich, alle Teilnahmedaten und Kontaktdaten unmittelbar nach dem Versand des Gewinns dauerhaft zu löschen.   • Der Gewinn wird den Gewinnern von OneFootball per Post zugesandt. Die Zustellung ist auf Deutschland beschränkt und kostenlos. Die Gefahr der Verschlechterung oder des Verlusts des Gewinns geht auf die Gewinner über, sobald der Gewinn an den Versanddienstleister oder die Post übergeben wird. OneFootball haftet nicht für Schäden, Verluste oder Verzögerungen, die während der Lieferung entstehen können.
  • OneFootball haftet nicht für falsche Informationen, die von Teilnehmern und/oder Dritten, einschließlich etwaiger Kooperationspartner von OneFootball, im Zusammenhang mit der Bewerbung der Verlosung geäußert und verbreitet werden. OneFootball haftet auch nicht für Schäden, die durch technische Störungen, Verzögerungen oder Unterbrechungen von Übertragungen entstehen, oder für Schäden, die im Zusammenhang mit der Teilnahme an der Verlosung oder der Annahme und Nutzung des Gewinns entstehen, es sei denn, OneFootball oder seine Vertreter handeln vorsätzlich oder grob fahrlässig. Ebenso ist die Haftung von OneFootball und seinen Erfüllungsgehilfen für Verletzungen vertraglicher Pflichten und für unerlaubte Handlungen auf Vorsatz und grobe Fahrlässigkeit beschränkt. Schadensersatzansprüche wegen Verletzung des Lebens, des Körpers, der Gesundheit oder wesentlicher Vertragspflichten bleiben unberührt.
  • Eine Barauszahlung des Wertes des Gewinns sowie ein Umtausch oder eine Sachauszahlung sind ausgeschlossen.
  • OneFootball behält sich das Recht vor, die Verlosung jederzeit ohne vorherige Ankündigung und ohne Angabe von Gründen ganz oder teilweise abzubrechen. Dies gilt insbesondere, wenn die Verlosung nicht wie geplant durchgeführt werden kann, z. B. im Falle von Computerviren, Software- und/oder Hardwarefehlern und/oder aus anderen technischen und/oder rechtlichen Gründen. Dies gilt auch im Falle von Manipulation(en) oder Manipulationsversuchen, die die ordnungsgemäße Durchführung der Verlosung beeinträchtigen.
  • Der Rechtsweg ist ausgeschlossen.
  • Diese Teilnahmebedingungen unterliegen ausschließlich den Gesetzen der Bundesrepublik Deutschland unter Ausschluss der Bestimmungen des internationalen Privatrechts. Ausschließlicher Gerichtsstand für alle Streitigkeiten, die sich aus oder im Zusammenhang mit diesen Bedingungen ergeben, ist Berlin, Deutschland.
  • Diese Teilnahmebedingungen stellen die endgültigen Bedingungen für die Verlosung dar. Sollten einzelne Bestimmungen dieser Bedingungen ganz oder teilweise unwirksam oder undurchführbar sein oder werden, so wird dadurch die Gültigkeit der übrigen Bedingungen nicht berührt.
