1F PLAY - Prize TOURNAMENTS

TERMS AND CONDITIONS

By accessing or using 1F Play GameHub ("GameHub"), a feature of the OneFootball App, you agree to these Prize Tournament Terms and Conditions ("Terms"). These Terms are issued by OneFootball GmbH ("OneFootball"). These Terms should be read together with the 1F Play GameHub Terms of Use and the OneFootball App Privacy Policy. Capitalised terms used but not defined here have the meanings given in the GameHub Terms of Use.

  1. These Terms apply to your participation in any Tournament available through GameHub (each, a "Tournament"). Each Tournament is operated by OneFootball GmbH, Donaustraße 44, 12043 Berlin, Germany.

  2. This Tournament is in no way sponsored, endorsed, administered by, or associated with Apple Inc. or Google LLC. Where GameHub is accessed via an app on the iOS or Android platform, participants acknowledge that any queries, complaints, or claims relating to the Tournament must be directed to OneFootball and not to Apple or Google, and that Apple and Google have no obligation whatsoever to furnish any support services in connection with the Tournament.

  3. GameHub is free to play. No purchase of goods or services is required to access GameHub or to participate in any Tournament.

  4. Only individuals who are at least 18 years old and reside in the United Kingdom are eligible to participate in any Tournament. Employees of OneFootball GmbH (and any of its affiliates) are excluded from participating in any Tournament.

  5. OneFootball reserves the right to exclude participants from a Tournament for good cause. This may include, but is not limited to, violations of these Terms, as well as any attempt to manipulate the Tournament or disrupt its proper conduct (e.g., through the use of automated scripts, hacking tools, Trojans, or viruses). In these instances, prizes may be subsequently revoked. Specifically, instances of manipulation that may result in exclusion from GameHub include collective or multiple entries (e.g., if a participant creates or uses multiple accounts to enhance their chances of winning).

  6. The exact start date, end date and Closing Date for each Tournament, as well as the prize(s) available to be won in that Tournament (the "Tournament Prize"), are set out on the relevant official tournament page for that Tournament within GameHub (the "Tournament Page"). Each Tournament closes at 11:59 pm (CET) on the closing date specified on the applicable Tournament Page (hereinafter referred to as the "Closing Date").

  7. OneFootball reserves the right to substitute the Tournament Prize, in whole or in part, with an alternative prize of equal or greater value if the original prize becomes unavailable for any reason, including but not limited to being out of stock, discontinued, or lost in transit. OneFootball's decision on any substitute prize shall be final.

  8. To enter a Tournament, participants must open GameHub, navigate to the relevant Tournament Page and select the Tournament by clicking the "Join" button.

  9. The winner will be the participant with the highest score at the end of the relevant Tournament. Where two or more participants achieve the same highest score in the same fastest time, those participants will be declared joint winners.

  10. The winner will be notified by OneFootball via email within ten (10) Business Days of the Closing Date. The winner must confirm receipt of the prize notification to OneFootball within five (5) business days of receiving it and provide their full name and postal address (hereinafter referred to as "Contact Details") via email for the purpose of prize delivery. In the event that a winner does not provide their Contact Details to OneFootball within five (5) business days of receiving the prize notification, the Tournament Prize may be forfeited, and OneFootball reserves the right to select a new winner.

  11. By participating in a Tournament, the participant expressly agrees that their Contact Details will be processed by OneFootball solely for the purpose of fulfilling the contract related to the shipment of the Tournament Prize. OneFootball commits to permanently deleting all Contact Details within 12 months of the Tournament Prize being shipped, save that OneFootball may retain a winner's surname and country for as long as required to comply with its obligations under the UK CAP Code, including making this information available to the Advertising Standards Authority or members of the public upon reasonable request to verify that a valid award took place. For more information about data protection, please refer to Section 3.9 of our Privacy Policy.

  12. The Tournament Prize will be sent to the winner by OneFootball via postal service. Delivery is limited to the United Kingdom and free of charge. The risk of deterioration or loss of the Tournament Prize passes to the relevant winner once the Tournament Prize is handed over to the postal service. OneFootball shall not be liable for any damage, loss or delay that may occur during delivery.

  13. OneFootball is not liable for false information provided or disseminated by participants and/or third parties, including any cooperation partners of OneFootball, in connection with the promotion of the Tournament. OneFootball is also not liable for damages caused by technical failures, delays, or interruptions in transmissions, or for damages incurred in connection with participation in the Tournament or the acceptance and use of the Tournament Prize, except where OneFootball or its agents act intentionally or grossly negligent. Likewise, the liability of OneFootball and its vicarious agents for breaches of contractual obligations and for tort is limited to intent and gross negligence. Claims for damages due to injury to life, limb, health, or essential contractual obligations remain unaffected.

  14. Payment of the value of the Tournament Prize in cash as well as exchange or payment in kind is excluded.

  15. The winner of a Tournament Prize is solely responsible for any and all tax liabilities, duties, or other charges arising from their receipt of the Tournament Prize. OneFootball accepts no responsibility for any tax obligations incurred by the winner as a result of winning or receiving the Prize.

  16. OneFootball reserves the right to cancel the Tournament, in whole or in part, at any time without prior notice and without providing reasons. This is particularly applicable if the Tournament cannot be carried out as planned, e.g., in the event of computer viruses, software and/or hardware errors and/or for other technical and/or legal reasons. This also applies in the event of manipulation(s) or attempts at manipulation that compromise the proper conduct of the Tournament.

  17. These terms and conditions shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the provisions of international private law. The exclusive place of jurisdiction for all disputes arising out of or in connection with these terms and conditions shall be Berlin, Germany.

  18. Legal recourse is excluded.

  19. These Terms represent the final terms and conditions applicable to the Tournaments. Should any individual provision of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
