OneFootball FanShop – Terms and Conditions
1. Scope and General Provisions
1.1 These Terms and Conditions (the "T&Cs") apply to all purchases of goods (the "Products") made by consumers (the "Buyer" or "you") through the OneFootball App or website (the "Platform") – both for Products offered by third-party sellers (the "Third-Party Seller") and for Products sold by OneFootball GmbH itself ("Sold by OneFootball"). For each Product, it is clearly indicated before you place your order whether the sale is made "by OneFootball" or "by [name of the Third-Party Seller]".
1.2 The term "Seller" means, in these T&Cs, the respective party to the purchase contract, i.e. – depending on the Product’s designation – either the Third-Party Seller or OneFootball GmbH.
1.3 A "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. The purchase of Products for commercial resale is strictly prohibited.
1.4 By placing an order, you agree to be bound by these T&Cs. These T&Cs govern the relationship between you and the respective Seller.
2. Role of OneFootball and Contractual Relationship
2.1 Sales by Third-Party Sellers: For Products marked "Sold by [Third-Party Seller]", OneFootball solely provides the technical infrastructure (the online marketplace) enabling Third-Party Sellers to list and sell their Products. In this case, OneFootball is not a party to the purchase contract; it is concluded exclusively between the Buyer and the respective Third-Party Seller. OneFootball does not act as a buyer or seller, nor does it assume any liability for the performance of the sales contract, the condition of the Products, or the handling of physical returns.
2.2 Sales by OneFootball: For Products marked "Sold by OneFootball", OneFootball GmbH sells the Products itself. In this case, OneFootball is a party to the purchase contract and acts as trader and seller with all statutory seller obligations – in particular regarding the right of withdrawal, the statutory warranty, delivery and returns. All rights and obligations that these T&Cs assign to the "Seller" then apply to OneFootball.
2.3 The complete identity of the respective Seller – for Third-Party Sellers including their legal form, authorized representatives, registered address and contact details; for Sales by OneFootball, the details set out in the legal notice (Impressum) – is transparently displayed on the respective product detail page and in the checkout process.
2.4 Status of Sellers and transparency: All Third-Party Sellers offering Products on the Platform act as traders (businesses); the full range of consumer protection rights therefore applies to your purchase. The same applies to purchases from OneFootball. Where Products are presented as ranked search results, the main parameters determining ranking and their relative importance are disclosed in a dedicated, easily accessible part of the Platform; any preferential treatment of OneFootball’s own Products is indicated.
3. Conclusion of Contract
3.1 The presentation of Products on the Platform does not constitute a legally binding offer by the Seller, but rather an invitation to treat (invitation to place an offer).
3.2 By clicking the binding purchase button (e.g., "Order with obligation to pay"), you submit a legally binding offer to conclude a purchase contract with the respective Seller.
3.3 The purchase contract is officially concluded when you receive an order confirmation via email (constituting the Seller’s acceptance) or when your selected payment method is charged, whichever occurs first.
4. Prices and Shipping Costs
4.1 All prices displayed on the Platform are total prices, including applicable statutory Value Added Tax (VAT).
4.2 Shipping costs are not included in the product price. They are calculated dynamically based on the delivery destination and the Seller’s shipping policies, and are clearly displayed to the Buyer before the order is finalized.
5. Payment Processing
5.1 Payment processing is securely handled via the authorized payment service provider Stripe (Stripe Payments Europe Ltd., Ireland).
5.2 Available payment methods (e.g., Credit/Debit Card, Apple Pay, Google Pay, PayPal, Klarna) will be displayed during the checkout process.
5.3 Where the Seller is a Third-Party Seller, by accepting these T&Cs you consent to that Seller assigning its payment claims to third parties (such as Stripe) for processing. For Sales by OneFootball, OneFootball is directly the creditor of the payment. In both cases, you agree to receive invoices and credit notes electronically.
6. Delivery and Retention of Title
6.1 Delivery times vary by Seller and destination. The estimated delivery time is indicated on the product page and in the checkout process.
6.2 The Products remain the legal property of the Seller until full payment of the purchase price has been received (retention of title).
6.3 Passing of risk and delivery time: The risk of loss of or damage to the Products passes to you only when you (or a third party indicated by you, other than the carrier) have acquired physical possession of the goods. Unless a different delivery time is indicated, the Seller will deliver without undue delay and no later than 30 days after conclusion of the contract.
7. Right of Withdrawal (Right of Cancellation)
7.1 If you are a consumer residing in the EU, you have a statutory right of withdrawal when purchasing goods on the Platform.
7.2 The full, legally required Cancellation Policy (Widerrufsbelehrung), including instructions on how to exercise your right, the effects of withdrawal, and the Model Withdrawal Form, can be found in the Annex at the end of these T&Cs.
7.3 Note on exercising your right: You may declare your withdrawal centrally to OneFootball in all cases. For Products marked "Sold by OneFootball", OneFootball is in any event your direct contractual partner. For Products from Third-Party Sellers, OneFootball acts for this purpose as the legally authorized receiving agent of the respective Third-Party Seller. The goods must always be returned to the return address stated in your order confirmation (for Sales by OneFootball, to OneFootball; for Third-Party Sellers, directly to the respective Third-Party Seller). Full details are provided in the Annex.
8. Statutory Warranty (Legal Guarantee for Conformity)
8.1 All Products sold on the Platform are covered by statutory warranty rights (legal guarantee of conformity) under the applicable EU Sale of Goods directives and local implementations. For Sales by OneFootball, OneFootball is the party liable to you under the statutory guarantee of conformity.
8.2 If a Product is defective or not as described, you are entitled to have the goods repaired or replaced free of charge by the Seller. If this fails, is impossible, or causes disproportionate inconvenience, you may be entitled to a price reduction or to cancel the contract.
8.3 Any commercial guarantees voluntarily offered by a Seller or a manufacturer are in addition to, and do not affect, your mandatory statutory warranty rights.
8.4 The duration of the statutory guarantee of conformity follows the law of your country of habitual residence and is not shortened by these T&Cs. It is generally two (2) years from delivery in Germany, Austria and Italy, and three (3) years from delivery in Spain. In Germany, Austria and Italy, any lack of conformity that becomes apparent within the first year after delivery is presumed to have existed at delivery, unless proven otherwise (in Spain, this presumption applies for two years). These rights are free of charge.
9. Dispute Resolution
Neither OneFootball nor the Third-Party Sellers are obliged, nor do they commit, to participate in alternative dispute resolution procedures before a consumer arbitration board, unless required by mandatory national law.
10. Applicable Law and Jurisdiction
10.1 These T&Cs and the contractual relationship between the Buyer and the Seller are governed by the laws of the Federal Republic of Germany, expressly excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 Mandatory Consumer Protection (Rome I Regulation): If you are a consumer and have your habitual residence in another EU Member State (such as Austria, Italy, or Spain), the choice of German law in Section 10.1 does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of your country of residence (mandatory consumer protection laws).
10.3 If the Buyer is a consumer, legal proceedings may be brought either in the competent courts of Germany or in the competent courts of the Buyer’s place of habitual residence.
ANNEX: Cancellation Policy & Withdrawal Form
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform the respective Seller (for Sales by OneFootball, OneFootball GmbH; otherwise the Third-Party Seller stated in your order) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). You may validly submit your statement, in all cases, to:

You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we (the Seller) shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Return of Goods: You shall send back the goods or hand them over directly to the Seller stated in your order confirmation (OneFootball or the respective Third-Party Seller), without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract. The specific return address is provided in your order confirmation email. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
